Transgender rights in the context of current Western cultural debates
Abstract
PhDs, Post-Docs, professors as well as interested external auditors, are cordially invited to participate in and contribute to our seminar series titled: “Human Rights: Insights into Today’s Challenges” hosted by the Doctoral School of Law. The aim of the seminar is to have an in depth discussion on a different human rights issue in each seminar. Presentations of 15 to 20 minutes (or up to 30 minutes if we have two or more speakers) will be followed by an open group discussion.
Transgender rights are one of the most recurrent topics in the present culture wars happening in Western countries. In 2024, the Court of Justice of the European Union rendered a key judgment in this particular matter: C-4/23,Mirin. This decision captures the existing fragmentation across the EU when it comes to legal gender recognition. While some EU Member States have simplified the procedure to legally change the gender to a mere administrative step, in others medical examinations and judicial approval are still required. The case also exposes the challenges that such fragmentation can create for EU citizens when exercising their right to freedom of movement. The presentation will rely on this judgment as the basis to explore the CJEU and the ECtHR position regarding legal gender recognition
