Comparative Law “in Layers”
Abstract
You are invited to participate in and contribute to a seminar dedicated to current issues of EU law, with a focus on recent case law and research covering a wide range of topics.
The presentation will highlight a phenomenon in comparative law that can be frequently observed, but is little-discussed. Depending on the “level” at which a comparison is pitched, systems may appear either to converge or to diverge, only for the conclusion to be qualified as soon as one moves on to the next “level” down. This phenomenon appears to pervade both macro- and microcomparisons. Using specific examples, the aim of the presentation is to generate an awareness of the phenomenon and to discuss its practical implications for the study of comparative law.
The presentation will be followed by a discussion.
PhD students are encouraged to actively contribute to the seminar.
