Lecture SeriesThe European Union as global international actor: strategic autonomy in a changing international context
The Department of Law of the FDEF, with the support of the FNR and the Erasmus + Programme of the European Commission, and in collaboration with the LCEL, is organising this lecture.
Abstract

Has the international investment law (IIL) in recent years indeed become greener – or is it merely being greenwashed? The lecture will discuss how the existing regulatory framework of international investment treaty law (including investment agreements and investment chapters of trade agreements) addresses the issue of environmental protection, with a focus on the regulation of investor conduct. It will examine to what extent the IIL instruments introduce investor obligations, safeguarding environmental common goods. Types of such obligations, as well as the issue of their enforceability, will be considered. The lecture will also comment on the interpretation of relevant treaty provisions, offered by the Investor-State Dispute Settlement practice.

Joanna LAM is an established expert in international business law and arbitration. Her recent research examines, inter alia, regulation of Special Economic Zones; international investment law and the green energy transition; third party participation in arbitration; and cross-border assignment in private international law.
