Abstract

Investment fund regulation delineates eligible assets for different types of investment funds. Notably with respect to retail investment funds, open for the public and not only limited to professional or institutional investors, the investment limits are defined strictly by European regulation. The presentation will lay out to what extent investments by investment funds into crypto-assets are possible, how they are regulated, and how risks relating to crypto will be managed. It concludes on how a coherent legal framework should be construed in order to regulate the risks associated to crypto-assets without hindering innovation.
