As AI systems shape public governance, their impact on fundamental rights is more critical than ever. In her forthcoming monograph publication, Dr. Elif Biber, postdoctoral researcher European Public Law and Digitalisation at the University of Luxembourg, argues the limits of European legal frameworks including the much-debated EU AI-Act and examines real-world cases where AI has challenged fundamental rights.
“To meet these urgent challenges, I propose a rights-based inter-legal approach, delving into the theory of inter-legality, integrating leading European Court of Human Rights and European Court of Justice case law on new technologies,” explains Dr. Biber. “I also introduce a three-step adjudication model designed to enhance AI governance and rights protection.”
