1.Principles of European Union Law:This course will study the principles related to the identity of the European Union (principles linked to autonomy and the rule of law), the principles governing the interaction of the European and the national legal orders (sincere cooperation, primacy, effectiveness), as well as those concerning the protection of individuals (effective judicial protection, principle of non-discrimination, principle of proportionality and fundamental rights protection) and the European governance (transparency, democracy, institutional balance). The principles will be analyses as such, but also from a transversal perspective (harmonization, mutual trust) and in the light of the judicial review in the judicial system of the Union. 2.Methodology, Legal Theory and European Integration:This course will study the impact of judicial reasoning on social integration in general (taking into account recent developments in United States case law), with a special emphasis on European Legal Reasoning and European Integration.

1. Libertés fondamentales dans le marché intérieurLe cours – enseigné en français – vise à sensibiliser les étudiants aux aspects transversaux et à l’interaction de plus en plus féconde entre les libertés fondamentales (libertés de de circulation) et les autres droits fondamentaux dans le cadre du droit de l’Union européenne.Le suivi de cet enseignement présuppose de solides bases dans le droit matériel de l’Union européenne. Le cours vise à approfondir la thématique des libertés de circulation en focalisant sur leurs aspects communs et leur relation avec les droits fondamentaux. Dans le déroulement des séances des exercices pratiques tels que des cas pratiques, la recherche de jurisprudence, analyse de jurisprudencerécente etc. auront lieu.L’examen se déroulera sous la forme d’une épreuve écrite de trois heures. Les sujets d’examen des années précédentes seront publiés sur Moodle à titre d’exemple.2. Fundamentals of EU Competition LawEU competition law (notably Articles 101/102 TFEU, but also Articles 106, 107 and 108 TFEU). The course is taught in English and focuses on the essential substantive and organizational/procedural rules and concepts governing EU competition law public and private enforcement, including fundamental rights protection and access to justice.The written exam (three hours) normally consists of a transversal topic or a case study guided by specific questions.

1. European and International Human Rights LawThis course provides a compact but general introduction to international human rights law. It covers the foundations of international human rights law, institutional protection, a number of individual and collective rights, and a series of cross-cutting issues posing particular challenges for the effective protection of human rights in various contexts.The course is divided into three parts: Part I discusses the historical and theoretical foundations of human rights and the normative framework of human rights protection. This includes an analysis of the sources of human rights law, such as treaties, customary international law and general principles of law. Part II is devoted to the practical aspects concerning the application of human rights at the international (UN Charter system) and regional levels (European and Inter-American systems). It examines the main procedures for bringing complaints of human rights violations. This includes an examination of both national and international human rights jurisprudence and of non-binding decisions of human rights committees, especially in the UN context. Part III focuses on the various types of human rights, including individual rights (social and political) and collective rights (self-determination, minorities and indigenous peoples). It further examines human rights in the broader context, discussing both promises and challenges that have become apparent in addressing pressing issues. These include protection during times of armed conflict, the difficulties posed by multinational corporations for the system of human rights protection and the application to climate change of the right to a healthy environment.2. Citoyenneté et droits fondamentauxCe cours explore la protection des droits fondamentaux et des droits des citoyens dans le système juridique de l’Union européenne, en tenant compte notamment de l’évolution de la jurisprudence de la Cour de justice de l’UE et, également, de la Cour européenne des droits de l’homme.Le cours présente les sources des droits fondamentaux de l’UE. Il aborde notamment le rôle de la jurisprudence de la Cour de justice dans le système des droits fondamentaux de l’UE, la Charte des droits fondamentaux de l’UE, la protection des droits fondamentaux de l’UE dans les États membres. La suite du cours sera consacrée à l’examen de manière plus topique et ciblée de certaines questions afférentes à la consécration des droits fondamentaux qui sont plutôt d’actualité. Elle explore ainsi la jurisprudence récente de la Cour de justice et la Cour européenne des droits de l’homme notamment sur l’État de droit, l’indépendance de la justice, l’asile et le mandat d’arrêt européen, le principe ne bis in idem et les droits sociaux.

1. Digital single marketThe course gives a first insight into the international, European and national space, communication and media law. • In the part taught by Prof. Hofmann the course analyses the UN legal framework of space activities and the rules of the International Telecommunication Union, as well as studies the legal framework of the European Space Agency and of space programs of the European Union. Additionally, the course gives an overview of national space and telecommunication legislation of selected countries, including Luxembourg. • In the part taught by Prof. Cole the course gives an overview of key elements of media law in the context of the European Union. It will present the relevance of fundamental rights and freedoms and give a few examples for sector specific rules on EU level. With that, the course displays the scope of topics that are basis of the specialised Master in Space, Communication and Media Law as it is offered in the second year of the Master in Law programmes at the University of Luxembourg. 2. Company lawEuropean company law, meaning the study of European law bearing on the topic of company law at large, which includes the case law of the Court of Justice of the European Union on the topic of freedom of establishment, the directives, regulations and recommendations applying to the members states’ companies or directing the member states to bring some orientation to their national company law systems and, finally, the existing European entities (European Company, European Economic Interest Grouping, European Cooperative Society).

1. European Criminal LawThe course focuses on the institutional framework and historical background of European criminal law. It identifies the sources of European criminal law (e.g., Council of Europe, Schengen, and the former Third Pillar of the EU) and the relationships among them. It explores the role and interplays among the different European and national institutions in developing European criminal law, as well as the European instruments dedicated to the approximation of criminal law and criminal procedure. Finally, it discusses key policy choices relating to the future development of European criminal law with a specific focus on financial and banking crimes at European level. 2. International and Comparative Criminal justiceThe course will focus on the European public prosecutor office recently established with its headquarter in Luxembourg. The programme will include the material scope of the EPPO – offences affecting the EU financial interests – as well as its operational setting. The different organs composing the EPPO as well as the several phases of the proceedings will be analysed in light of the different legal traditions existing among the Member States. Comparative criminal procedure is used as a tool to understand the complexity of the EPPO design and its potential impact on fundamental rights of the defendant. A final session will focus on the adaptation of national systems to the needs of the EPPO will close the course.
