Professor of Criminal Law at the University of Luxembourg, Stefan Braum, has recently authored a book entitled “Experimental Law: The Rule of Law and the Regulation of the Corona Pandemic in Europe.” From publisher Nomos, this volume features contributions from professors and researchers from the FDEF Department of Law, Prof. Jörg Gerkrath, Dr. Basak Baglayan, Dr. Fatima Chaouche, Prof. Séverine Menétrey and Prof. Silvia Allegrezza along with researchers from France, Spain, UK, Germany, Italy and Singapore providing a comparative law perspective through divergent national models of pandemic regulation.
The book showcases the work of three-year project PROLAW, coordinated by Prof. Stefan Braum which began as a FNR COVID-19 Fast Track project in April 2020. Researchers evaluate the implications of combating the pandemic for basic principles of the rule of law and for the various system levels of the law, asking if best practices can exist within the context pandemic control. Researchers further analyse if models and models of legal regulation of a pandemic be derived from the geopolitical context. The work aims to provide conclusions and recommendations which could be applied to respective national legislation as questions arise to what extent the European legal framework must be strengthened, even harmonized during times of sanitary crises.
