Comparative research on the liability of business heads in the EU as well as economic and financial crime has been published in two separate volumes, co-edited by the Dean of the Faculty of Law, Economics and Finance, Prof. Katalin Ligeti.
“Punitive Liability of Heads of Business in the EU: A Comparative Study”, published by Wolters Kluwer and CEDAM, addresses the issue of large corporations being punished for economic offences and the liability of senior managers versus the sacrificing of a “rogue employee” scapegoat. The study, which was co-funded by the European Commission’s European Anti-Fraud Office (OLAF), offers an in-depth analysis of Finnish, French, German, Dutch and Polish liability laws. Showing the lack of harmonisation across the EU in this field, the authors also make a number of policy recommendations aimed at protecting the EU’s financial interests in such cases.
Published by Hart, “White Collar Crime. A Comparative Perspective” outlines how white collar crime has expanded over the past two decades as well as the resulting changes to national, international and supranational law and punishing regimes. In addition to tracing the response of France, Germany, Poland and Sweden to these changes, the book also compares the European approach to the American response. Special attention is paid to economic and financial crime, including the Senior Managers Regime, corporate criminal liability, and whistle-blower protection. The work is part of a series of books published in coordination with the European Criminal Law Academic Network (ECLAN), which is coordinated by Prof. Ligeti.
In the framework of ECLAN, the Faculty of Law, Eonomics and Finance also recently hosted a PhD seminar during which around 20 doctoral candidates from the University of Luxembourg and ECLAN member universities from around Europe presented and discussed their research.
In addition to these volumes, Prof. Ligeti’s co-edited book on “Preventing and Resolving Conflicts of Jurisdiction in EU Criminal Law” was also recently published.
