This talk concerns one of the perhaps most striking developments in international law and society over the 20th century and well into the 21st century: the proliferation of international courts and how it is impacting societies across the world. The talk first explains the rise of international courts since the beginning of the 20th century and then secondly explores the tensions that this evolution has produced in several instances. A particular focus will be on the two regional European courts, the European Court of Human Rights and the Court of Justice of the EU.
