EU anti-discrimination legislation has existed since the 1970s in respect of gender equality and since 2000 for the grounds of racial or ethnic origin, religion or belief, disability, age and sexual orientation. Yet research continues to disclose persistent inequalities in the labour market, such as the gender pay gap. Surveys also indicate that only a minority of people raise a formal complaint if they experience discrimination or harassment at work. This lecture will reflect upon the strengths and limitations of the individual rights model that characterises EU anti-discrimination law. It will consider options for reform of the legal framework in order to enhance its effectiveness.
