Abstract
The EU Commission’s Proposal for an “Unshell Directive” was intended to complement efforts to tackle aggressive tax planning found in the ATAD and DAC. As proposed, this directive would introduce effective substance requirements for companies to claim tax treaty benefits in a EU Member State. Yet, one year after the draft’s publication, no agreement has been reached in the Council, and various amended proposals are in discussion. At this workshop, leading international and EU law experts will analyse the proposal’s content, its compatibility with EU law, and the international tax perspective.
