Au c\u0153ur des exigences des libert\u00e9s de circulation concourant \u00e0 la r\u00e9alisation du march\u00e9 int\u00e9rieur, la notion d\u2019entrave aux \u00e9changes a fait l\u2019objet de d\u00e9finitions fluctuantes de la part des institutions de l\u2019Union europ\u00e9enne.<\/p>\n\n\n\n

Appel\u00e9e \u00e0 r\u00e9pondre, sur renvoi pr\u00e9judiciel, \u00e0 des demandes d\u2019interpr\u00e9tation des articles des trait\u00e9s constitutifs et des actes de droit d\u00e9riv\u00e9, la Cour de justice a \u00e9t\u00e9 amen\u00e9e \u00e0 d\u00e9finir la notion d\u2019entrave aux \u00e9changes tout particuli\u00e8rement au sujet des libert\u00e9s de circulation applicables aux marchandises, puis des services et des capitaux ainsi qu\u2019en mati\u00e8re de droit de la concurrence.<\/p>\n\n\n\n

C\u2019est dans le cadre de la libre circulation des marchandises que la notion a \u00e9t\u00e9 la plus controvers\u00e9e. Devait-on exiger le constat d\u2019une discrimination mat\u00e9rielle voire formelle ? Devait-on distinguer en fonction des types de r\u00e9glementations mises en cause ? Quels devaient \u00eatre les effets de la prise en consid\u00e9ration des justifications des r\u00e9glementations sur la notion d\u2019entrave ?<\/p>\n\n\n\n

La question demeure de savoir quels sont les crit\u00e8res significatifs de l\u2019entrave aux \u00e9changes. La notion d\u2019acc\u00e8s au march\u00e9, mise en lumi\u00e8re au cours des ann\u00e9es 2000, suffit-elle \u00e0 nous \u00e9clairer sur l\u2019existence d\u2019une entrave aux \u00e9changes constitutive d\u2019une atteinte \u00e0 une libert\u00e9 de circulation ?<\/p>\n\n\n

Fabrice Picod is Professor of Public Law at the University of Paris-Panth\u00e9on-Assas, where he directs the European Law Centre, the Master\u2019s programme in EU Law and Litigation, and the Doctoral School in International, European, Comparative and International Relations Law. A former agr\u00e9g\u00e9 in public law and summa cum laude graduate of the University of Strasbourg, he holds a Jean Monnet Chair in EU Law and Litigation.
Professor Picod\u2019s teaching and research cover a wide range of EU legal fields, including internal market law, State aid, consumer protection, EU procedural law, institutional law, fundamental rights, and external relations. He has authored or edited numerous works, including a major commentary on the EU Charter of Fundamental Rights (Bruylant, 2023) and a guide to European business law (LexisNexis, 2021).
He has held visiting positions at the College of Europe, the Max Planck Institute, and the Universities of Luxembourg and Geneva. He co-directs the Annuaire de droit de l\u2019Union europ\u00e9enne<\/em>, serves as scientific director of Jurisclasseur Europe<\/em>, and sits on several editorial boards. His recent work focuses on EU crisis law, extraterritoriality, and the CJEU\u2019s case law. He regularly advises public institutions and trains legal professionals on EU law.<\/p>\n\n\n\n
