Aujourd&rsquo;hui, un nouveau rapport publi\u00e9 par des politologues de l&rsquo;Universit\u00e9 du Luxembourg et l&rsquo;association de d\u00e9fense des locataires (<em>Mieterschutz<\/em>) r\u00e9v\u00e8le les exp\u00e9riences qui sont source de tensions pour les locataires.&nbsp;<\/p>\n\n\n\n<p>Dans l\u2019\u00e9tude, les locataires ont exprim\u00e9 un certain nombre de sentiments n\u00e9gatifs \u00e0 l&rsquo;\u00e9gard du march\u00e9 locatif, les plus fr\u00e9quents \u00e9tant l&rsquo;injustice (47 %) et l&rsquo;ins\u00e9curit\u00e9 (24 %). Le mauvais \u00e9tat des logements est un probl\u00e8me fr\u00e9quemment cit\u00e9. Pr\u00e8s d&rsquo;un locataire sur cinq ayant \u00e9crit \u00e0 l&rsquo;association de protection a rencontr\u00e9 des probl\u00e8mes dans son logement, les groupes vuln\u00e9rables et ceux avec enfants \u00e9tant les plus touch\u00e9s. La moisissure ou l&rsquo;humidit\u00e9 sont les probl\u00e8mes les plus fr\u00e9quemment cit\u00e9s, suivis par les probl\u00e8mes de construction ou d&rsquo;\u00e9quipement, de chauffage ou de fuites.&nbsp;<\/p>\n\n\n\n<p>Ce sont quelques-unes des principales conclusions de l&rsquo;\u00e9tude conjointe \u00ab<em> The Tenant Experience in Luxembourg\u2019s Rental Market<\/em> \u00bb, men\u00e9e par <a href=\"https:\/\/www.uni.lu\/fhse-en\/people\/lindsay-flynn\/\" target=\"_blank\" rel=\"noreferrer noopener\">Lindsay Flynn<\/a>, Prof. de sciences politiques \u00e0 l&rsquo;Universit\u00e9 du Luxembourg. Cette \u00e9tude s&rsquo;appuie sur la correspondance anonymis\u00e9e entre pr\u00e8s de 300 locataires et Mieterschutz, ainsi que sur des groupes de discussion o\u00f9 les locataires ont partag\u00e9 leurs exp\u00e9riences avec l&rsquo;\u00e9quipe de recherche.<\/p>\n\n\n\n<section class=\"wp-block-unilux-blocks-quote-people\">\n    <div class=\"quote-people\" role=\"group\">\n        <figure class=\"quote-people__body\">\n            <blockquote class=\"quote-people__blockquote\">\n    <span class=\"quote-people__quote\">\u201f<\/span>\n    Ces donn\u00e9es collect\u00e9es entre 2022 et 2023 dressent un tableau r\u00e9aliste de ce que signifie \u00eatre locataire au Luxembourg. font-family: &quot;object-fit: cover; object-position: 51.00% 3.00%;&quot;; aspect-ratio: 3\/2; object-fit: cover; width: 100%;\"\n        loading=\"lazy\"\n\/>            <p class=\"wp-block-dev4-reusable-blocks-image-caption\">\n            Prof. Lindsay Flynn pr\u00e9sente les r\u00e9sultats du rapport lors d&rsquo;un \u00e9v\u00e9nement public.        <\/p>\n    <\/figure><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>L&rsquo;\u00e9tude \u00e9value les exp\u00e9riences en trois \u00e9tapes : durant la recherche d&rsquo;un logement, durant le bail et la fin du bail.<\/p>\n\n\n\n<ul class=\"ulux-list\">\n<li class=\"ulux-list-item\">La recherche d&rsquo;un logement locatif est entrav\u00e9e par des loyers inabordables, des crit\u00e8res de s\u00e9lection ou de la discrimination per\u00e7us, des conditions contractuelles ou un manque de clart\u00e9 des contrats de bail.<\/li>\n<\/ul>\n\n\n\n<ul class=\"ulux-list\">\n<li class=\"ulux-list-item\">Les probl\u00e8mes les plus fr\u00e9quemment signal\u00e9s pendant la dur\u00e9e du bail sont des mauvaises conditions de logement, les augmentations de loyer ou la responsabilit\u00e9 des r\u00e9parations.<\/li>\n<\/ul>\n\n\n\n<ul class=\"ulux-list\">\n<li class=\"ulux-list-item\">La fin du bail est rendue compliqu\u00e9e majoritairement par la restitution de la caution, l&rsquo;\u00e9tat des lieux de sortie et la r\u00e9siliation anticip\u00e9e ou l&rsquo;expulsion.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n\n\n<p>\u00ab Une situation d\u00e9j\u00e0 tendue peut-\u00eatre exacerb\u00e9e par divers facteurs, qu\u2019ils soient humains, juridiques ou contractuels \u00bb, explique Prof. Flynn. Les locataires \u00e9taient souvent incertains de leurs droits, par exemple en mati\u00e8re d&rsquo;augmentation de loyer, de responsabilit\u00e9 des r\u00e9parations et de l\u00e9galit\u00e9 de la r\u00e9siliation du contrat. Les termes techniques ou juridiques et les zones grises dans les contrats ajoutent une couche de complexit\u00e9 qui frustre les locataires, tandis que la relation entre locataires et propri\u00e9taires se d\u00e9t\u00e9riore souvent apr\u00e8s que les locataires ont signal\u00e9 un conflit ou une absence de r\u00e9ponse.&nbsp;<\/p>\n\n\n\n<p>Il convient \u00e9galement de noter que les groupes socio-\u00e9conomiques vuln\u00e9rables et les familles avec enfants ont rencontr\u00e9 des probl\u00e8mes plus graves et plus urgents, notamment en ce qui concerne les crit\u00e8res de s\u00e9lection par les propri\u00e9taires et la qualit\u00e9 des logements.<\/p>\n\n\n\n<h2 class=\"has-text-align-left wp-block-unilux-blocks-heading\"        id=\"recommandations-adaptees-et-applicables\"\n    >\n<strong><strong>Recommandations adapt\u00e9es et applicables<\/strong><\/strong><\/h2>\n\n\n\n<p>Le rapport consacre un chapitre aux solutions politiques propos\u00e9es, directement adaptables au march\u00e9 locatif local. \u00ab Nous constatons en particulier que le manque d&rsquo;acc\u00e8s aux informations compr\u00e9hensibles, la m\u00e9connaissance des droits, des responsabilit\u00e9s ou des obligations p\u00e8sent sur les relations \u00bb, explique Prof. Flynn. \u00ab Des strat\u00e9gies visant \u00e0 am\u00e9liorer l&rsquo;acc\u00e8s \u00e0 l&rsquo;information, la transparence et l&rsquo;accompagnement peuvent contribuer \u00e0 \u00e9viter les situations qui surviennent avant, pendant et \u00e0 la fin du bail. \u00bb<\/p>\n\n\n\n<p>L&rsquo;accessibilit\u00e9 financi\u00e8re et les conditions de logement sont des probl\u00e8mes persistants qui n\u00e9cessitent une approche multiforme de la part des institutions publics, en particulier pour les m\u00e9nages vuln\u00e9rables et ceux avec enfants. Des informations et des outils pour les communications formelles et le r\u00e8glement des litiges entre locataires et propri\u00e9taires contribueraient \u00e0 \u00e9viter certains probl\u00e8mes et \u00e0 r\u00e9duire les tensions. L&rsquo;\u00e9valuation des politiques peut permettre d&rsquo;appr\u00e9cier la clart\u00e9 des r\u00e9glementations et d&rsquo;identifier des strat\u00e9gies visant \u00e0 r\u00e9duire les malentendus.<\/p>\n\n\n\n<p>D&rsquo;autres probl\u00e8mes n\u00e9cessitent des solutions plus complexes, avec une perspective \u00e0 long terme. Il s&rsquo;agit par exemple de la facturation irr\u00e9guli\u00e8re et indirecte des frais d\u2019\u00e9lectricit\u00e9, de chauffage ou autre. Ou encore de l&rsquo;accompagnement des locataires pour qu&rsquo;ils tirent parti des programmes existants, tels que les subventions de loyer et les programmes de garantie de caution. Les organisations en contact avec les locataires pourraient reconsid\u00e9rer les domaines dans lesquels elles investissent leurs ressources, par exemple en augmentant les ressources destin\u00e9es aux personnes qui ont besoin d&rsquo;une aide urgent concernant l\u2019accessibilit\u00e9 financi\u00e8re ou la qualit\u00e9 du logement. Elles peuvent \u00e9galement \u00e9valuer l&rsquo;efficacit\u00e9 du r\u00e9seau de soutien aux m\u00e9nages \u00e0 faibles revenus, en veillant \u00e0 ce que les m\u00e9nages vuln\u00e9rables parviennent \u00e0 r\u00e9soudre leurs litiges.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"has-text-align-left wp-block-unilux-blocks-heading\"        id=\"informations-sur-le-projet-de-recherche\"\n    >\n<strong>Informations sur le projet de recherche<\/strong><\/h2>\n\n\n\n<p>Tout au long du rapport, des donn\u00e9es ou des enqu\u00eates provenant d&rsquo;organismes publics, tels que l&rsquo;enqu\u00eate EU-SILC ou de l&rsquo;Observatoire de l&rsquo;Habitat, sont utilis\u00e9es pour contextualiser les r\u00e9sultats.&nbsp;&nbsp;<br>\u00ab Une vision compl\u00e8te et bilat\u00e9rale est n\u00e9cessaire pour proposer des recommandations politiques vraiment efficaces \u00bb, explique Lindsay Flynn. \u00ab Pour cela il faudra mener des \u00e9tudes suppl\u00e9mentaires pour comprendre d&rsquo;autres points de vue et situations critiques. \u00bb<br>Par exemple les exp\u00e9riences des propri\u00e9taires ou des situations critiques de litiges non inclus dans la correspondance sont des domaines essentiels \u00e0 analyser en profondeur afin d&rsquo;obtenir une vision plus accomplie.&nbsp;<\/p>\n\n\n\n<p>Cette \u00e9tude a \u00e9t\u00e9 command\u00e9e par Mieterschutz L\u00ebtzebuerg et r\u00e9alis\u00e9e avec le soutien financier du minist\u00e8re du Logement et de l&rsquo;Am\u00e9nagement du territoire et du projet FNR ATTRACT \u00ab <a href=\"https:\/\/www.uni.lu\/fhse-en\/research-projects\/propel-proactive-policymaking-for-equal-lives\/\" target=\"_blank\" rel=\"noreferrer noopener\">Proactive Policymaking for Equal Lives
